In dismissing a suit claiming a bank wrongly issued a 1099-C form and caused a defaulting credit cardholder to incur tax liability, the New York Supreme Court held that the bank securitized its credit card receivables but retained its ownership in the accounts themselves and, with it, the right to either collect on the debt or charge it off as a loss.  Chris Turcotte successfully defended the bank.
